When you started missing up payments, or maybe stopped making payments or exceed your credit limit, you can expect someone knocking at your door. These are the basic reasons why a collector will pursue bad debt collection.


There are times that collectors will be knocking even during odd hours. More so, they can give harassing calls and your mail box may get full. Though it is their right to collect the amount you defaulted, since they are the third party hired by the lending company, it seems that some of their actions might be against your rights. When it comes to bad debt collection, what are your rights that you need to know.


The law ensures your right against harassments or undue actions that you may get from collection efforts of your bad debt. When you are undergoing bad debt collection, the lender had turned over the account to a third party which is the debt collector. It is through the debt collector that you have to pay whether they are in cooperation with the original creditor or the already own the debt that you owe.

When you are in faced with bad debt collection, the outcome depends on how you face the problem. Below are some suggestions to make the situation go well.

* Debt collectors cannot call you at the place of your work if you refused. If your office would refrain you from receiving collector’s call and you have informed the debt collector, he has to legally comply. This is with regards to privacy of a person.

* Talk to the collector. Having known that you will be facing bad debt collection, you can talk to the debt collector to settle the collection. Discussing with them your financial condition will help you have good settlement with them and arrange the means they can contact you. Being honest and not hiding from them can promote better understanding than playing hide and seek.

* Find a plan. Most bad debt collection accounts can be reconfigured into more affordable payment scheme rather than one full payment. It has to be understood that for you to pay the debts, it will take small instalments to have the debt paid in full.


The law gives you right against troublesome collection efforts and yet it is your obligation to talk to them and settle your differences. This can paved way for a healthier bad debt collection that will be mutually beneficial to you and the collection agency.
